Ministry of Water, Lands and Resource Stewardship Allowing Modification of Air Space Parcel Subdivisions

The Urban Development Institute (UDI) has identified the implementation of the ability to create air space parcel (ASP) subdivisions during pre-construction, and modify ASPs after completion of construction to reflect the final “as built” boundaries, as a change which could have a significant impact on affordability and feasibility of rental residential developments (including mixed-use projects with a rental component) in the Province.
UDI is asking the Province to make the necessary legislative changes, to facilitate modification of internal boundaries within ASP subdivisions once a project has been built out. Implementing these changes would eliminate the perceived risks of early ASP subdivision, reduce barriers to building projects with a rental housing component accessing CMHC financing, contributing to cost saving and enhanced affordability, and address the potential of having to clutter title by registering complicated and likely multiple easements, should changes to the ASP boundaries be necessary.
