City of Surrey - Proposed Amendment to Zoning Bylaw for Community Specific Capital Projects Contributions (Tier 2 Community Amenity Contributions)

As mentioned in previous updates, on January 26th Council gave third reading and final adoption to the proposed amendments to the Zoning Bylaw to allow for partial deferral of Community Specific Capital Projects Contributions (Tier 2 Community Amenity Contributions, โ€œTier 2 CACsโ€) payments from the rezoning approval stage to the Building Permit stage for large-scale, multi-building development projects in order to encourage development of these projects to support the delivery of housing in Surrey.

At their meeting on January 12th, Council gave first and second reading to the proposed amendments to the Zoning Bylaw to allow for partial deferral of Community Specific Capital Projects Contributions (Tier 2 Community Amenity Contributions, โ€œTier 2 CACsโ€) payments from the rezoning approval stage to the Building Permit stage for large-scale, multi-building development projects in order to encourage development of these projects to support the delivery of housing in Surrey.

Tier 2 CAC Payment Collectionย 

This interim approach will apply to projects approved to proceed in multiple building phases where total Tier 2 CAC obligations exceed $10,000,000. Payments will be collected on a building-by-building basis, with an initial proportional payment collected at the time of rezoning approval. Payment installments will be calculated by dividing the total Tier 2 CAC obligation equally among the approved non-rental (strata) building phases only, excluding purpose-built rental buildings. Prior to rezoning approval, the owner of the project site will be required to enter into a Phased Development Agreement with the City securing the full Tier 2 CAC amount. There is no Letter of Credit or Surety Bond to secure this payment. No building permits will be issued until outstanding amounts are paid.
