City of Delta - Development Cost Charges

Adopted

As mentioned in previous updates, on January 20th, Council adopted the proposed amendments to the Development Cost Charges (DCC) Bylaw that would set a new effective date for the 2023 DCC Program rate increases, so that it is aligned with Metro Vancouver's DCC increase on March 22, 2025. 

The City will employ in-stream protection for applications that are in process prior to rate changes in accordance with the Local Government Act and Delta's DCC Bylaw. Staff will post on the City's website information on the DCC rate changes and their effective dates and will encourage applicants to reach out to staff with regard to individual projects.

Additionally, Council also approved a motion with the following recommendations: 

  1. That the City Manager be directed to have appropriate staff conduct a financial analysis on delaying collection of all development cost charges to time of issuance of occupancy permit instead of at time of subdivision application or issuance of a building permit depending on the land use category. 
  2. Council request the Honourable Minister of Housing and Municipal Affairs to consider amendments to applicable legislation in order to allow Local Governments to consider changing the time for collection of development cost charges. 
  3. Council request the Metro Vancouver Board of Directors, Translink Mayors Council and Board of Directors also consider changing the time for collection of development cost charges.

January 21, 2025

At their Special Council Meeting on December 18th, Council gave three readings to the proposed amendments to the Development Cost Charges (DCC) Bylaw that would set a new effective date for the 2023 DCC Program rate increases, so that it is aligned with Metro Vancouver's DCC increase on March 22, 2025. 

Staff have proposed the following amendments: 

• Table 1 DCC rates are effective from January 22, 2024 to March 21, 2025. 

• Table 2 DCC rates are effective as of March 22, 2025. 

The City of Delta will employ in-stream protection for applications that are in process prior to rate changes in accordance with the Local Government Act and Delta's DCC Bylaw. The bylaw will now be sent to the Province for Statutory Approval by the Inspector of Municipalities.

January 30th, 2024

As mentioned in previous updates, on January 23rd, Council adopted the updated Development Cost Charge (DCC) Bylaw. The City is proposing to phase in the DCC rate increase over two years using a higher municipal assist factor for the first year. The charges would approximately reach a 60% increase by year 2.

Year 1 (20% Municipal Assist Factor):

It is important to note that the 20% Municipal Assist Factor phase-in rate will only apply to applicants who apply and receive their building permit within one calendar year of the DCC Bylaw adoption date.

January 16th, 2024

On December 11th, 2023 Council gave Second and Third Reading to the updated Development Cost Charges Bylaw. There have been a few minor amendments to proposed rates to reflect feedback received through the consultation process, including a slight decrease from what was initially proposed at First Reading.

The City is proposing to phase in the DCC rate increase over a period of two years using a higher municipal assist factor for the first year.

It is important to note that the 20% Municipal Assist Factor phase-in rate will only apply to applicants who apply and receive their building permit within one calendar year of the DCC Bylaw adoption date.

Following Third Reading, the bylaw will be forwarded to the Province for approval by the Inspector of Municipalities. Once approved, the bylaw is expected to be brought to Council for final adoption. For more information, see the full report.

November 28th, 2023

On November 6th, 2023 Council gave First Reading to an update to the City's Development Cost Charges (DCC) Bylaw. This is considered a major review with new development projections and capital infrastructure projects list covering a period of 10 years.

The City is proposing to phase in the DCC rate increase over a period of two years using a higher municipal assist factor for the first year.

The increases amount to an overall ~60-115% increase over the two year phase-in period.

In-Stream Protection:

Per the requirements in the Local Government Act (LGA), the City will be providing a 12-month grace period for applications (i.e. rezoning, development permit, subdivision, building permit) submitted prior to the adoption date if the building permit (or subdivision) is approved/issued within the 12 months.

This 12-month grace period would only apply for the increases in the first year.

Other Proposed Changes include:

  • Change in the unit of charge for industrial so DCCs are charged based on per sq.m. of the gross floor area; and
  • Introduction of a DCC for institutional projects.

Timeline and Next Steps:

City staff presented the proposed changes to the DCCs in the last Delta Liaison Committee meeting and are seeking feedback until November 29th, 2023.

City staff anticipate bringing the draft DCC Bylaw to Council for Second and Third Reading at the December 4th, 2023 Regular Council Meeting after incorporating any industry feedback. If approved, the draft DCC Bylaw will be sent to the Ministry of Municipal Affairs for review and approval by the Inspector of Municipalities. Once approved, City staff expect to bring the DCC Bylaw for final adoption in early 2024.
