City of Delta - Housing Accelerator Permit Rebate Program

As mentioned in previous updates, on May 5th Council gave final adoption to the proposed amendments to the Consolidated Fees and Charges Bylaw to implement the Housing Accelerator Permit Rebate Program. This Rebate Program uses funding from the CMHC Housing Accelerator Fund (HAF) to discount eligible building permit fees and heritage conservation levies to incentivize housing. The emphasis of the Rebate Program is to accelerate the construction of new multi-unit, purpose-built rental, missing middle, and non-market housing to help achieve the City's Provincial Housing Target Order.

At their meeting on April 14th Council gave three readings to the proposed amendments to the Consolidated Fees and Charges Bylaw to implement the Canada Mortgage and Housing Corporation (CMHC) Housing Accelerator Permit Rebate Program. Establishing the Rebate Program to discount development fees is intended to use federal funding to accelerate the construction of new housing across Delta, with emphasis on multi-unit, purpose-built rental, missing middle, and non-market housing. Of the approximately $14.2 million in funding to be received by Delta from CMHC, $6 million is allocated to the Rebate Program. Eligible projects will be able to access the CMHC funds to pay for a portion of the municipal permitting fees.  

Program Eligibility and Proposed Fee Discount Rates 

As the intent of the program is to incentivize the development of more housing, the Rebate Program only applies to residential or mixed-use developments with residential components; other forms of development (e.g., commercial, industrial, institutional) are not eligible. Single detached dwellings without accessory dwelling units (ADUs) are also not eligible for any fee discounts. In accordance with CMHC's terms and conditions, the Rebate Program will be offered for a period of three years after final bylaw adoption. Projects that do not have a building permit issued prior to final bylaw adoption will be eligible to apply for the Rebate Program. The program would not be retroactive for permits already issued. 

Available Fee Discounts: 

Fee discounts would be calculated for each building individually at the time of building permit issuance. For buildings that contain non-market or purpose-built rental units, the applicable fee discounts would be available if:  

• The purpose-built market rental housing is secured through rental tenure zoning.  

• The non-market rental housing is secured through a housing agreement, operating agreement with a senior level of government, or similar legal mechanism at the discretion of the General Manager, Development. 

This program does not rebate any municipal or regional Development Costs Charges (DCC). 

Development Timeline Requirements for Multi-Family Market Projects 

To incentivize developments to be completed and available as new housing units, the Rebate Program includes milestones for multi-family market housing projects. For these projects, 50% of the available discount is available when a building permit is issued, as long as it is within the timeframe established in the bylaw. The remaining 50% of the discount shall be paid by the applicant at the time of building permit issuance as a deposit, which will be returned to the applicant if the issuance of an occupancy permit is done within the bylaw established timeframe.
